LEO STOLLER MOVES THE TTAB TO CANCEL THE GOOGLE INC., TRADEMARK
CHICAGO--THE SEVENTH CIRCUIT COURT OF APPEALS SUSTAINED LEO STOLLER APPEAL REVERSING NORTH DISTRICT OF ILLINOLIS JUDGE VIRGINIA KENDELL'S RICO JUDGMENT AGAINST THE CORPORATIONS THAT STOLLER
RAN. The Seventh Circuit vacated Google_Opinion.pdfthe settlement agreement between Illinois Bankruptcy Trustee Richard M. Fogel and Google Inc., which permitted Central Mfg Co withdraw its Petition to Cancel the "generic" and/or "discriptive" term 'google'. Now that the "frivilious" settlement agreements have been set aside, the Trademark Trial And Appeal Board (TTAB) must as a matter of law reinstate Stoller's Notice of Opposition No. 91170256 and the TTAB must Order Google Inc., file a written response to Stoller's Petition to Cancel No. 92045778, sue sponte, pending motion for summary judgment canceling the 'google' Registration. The Google Inc., Federal Registration for the discriptive term Google has been in the dictionary for several years now and thus is no longer entitled to Federal Registration as well known to every TTAB practicing judge. Google Inc., has been successful avoiding cancelation of its "generic" term by suing companies Stoller ran and preventing the TTAB from doing its job. The job of every defense lawyer when he has a "losing" case is to prevent that case from ever going to trial. Kudos must go to Google Inc.'s lawyer Michael T. Zeller Michael_T._Zeller_Attornet.pdf for their ability to have prevented the judges at the Trademark Trial and Appeal Board from canceling the "generic" google term off of the principle Register so far. But the Seventh Circuit Court of Appeals saw through Google Inc.'s lawyers duplicity and look to see the Google Inc., "descriptive" trademark erased from the Principle Register this year. Commissioner of Patents and Trademarks Jon Dudas and Office of the Enrollement and Discipline Director Harry Moatz who have been charged by AEAE with corruption for their failure too prosecute the said attorney disciplinary complaint OED_Attorney_Fraud_Complan.pdf against Lance G. Johnson, David Abrams and Alfred Goodman "respondents". By Dudas, Moatz and Sams doing "nothing" is evidence that they are all conplicit. There was a story out of Washington last week that both Dudas and Moatz will be terminated.
