Seventh Circuit Court of Appeals Gives Leo Stoller a Win Over Google Inc

CHICAGO--JUSTICES MICHAEL S. KANNE, ILANA DIAMOND ROVER AND DIANE S. SYKES OF THE SEVENTH CIRCUIT COURT OF APPEALS IN CHICAGO GAVE STOLLER A VICTORY BY GRANTING HIS APPEAL AGAINST GOOGLE INC. Google Inc., filed a "frivilious" Civil Rico Action Against Stoller in retailation for Stoller having filed a Petition to Cancel the "generic" Google trademark. Stoller was forced into filing a Chapter 13 bankruptcy which was converted to a Chapter 7. Google petitioned to lift the stay in order to sue Stoller in Federal District Court. Judge Jack B. Schmetterer lifted the stay, but Google entered into a "scheme" Stoller alleged with the Bankruptcy Trustee Richard M. Fogel, who consented to a "judgment" in the Civil Rico action, which when filed did not list Stoller has a necessary party. The scheme was to allow Google Inc., to obtain its Rico judgment against Stoller without Stoller have the right to defend himself. Stoller moved to intervene in the Disctict Court Case before Judge Virgina Kendell. Judge Kendell denied Stoller's motion to intervene and entered the "agreed" judgment. Stoller then appealed to the Seventh Circuit Court of Appeals. On April 2, 2008 the Seventh Circuit issued an Order
reversing Judge Kendel and remanding the case back to her for further hearings. Robinson and bankruptcy Trustee Richard M. Fogel ("respondents") had violated the Illinois Rules of Professional Conduct in an alleged "scheme" to defraud the Bankruptcy Court and the District Court in order to procure the decision that the Seventh Circuit Court of Appeals has now reversed. The ARDC initialy choose not to prosecute because of the pending litigation before the District Court, but invited Stoller to refile his disciplinary complaint(s) once the "court" has ruled. The Seventh Circuit Court of Appeals has now spoken. Stoller an attorney ethics expert has now refiled his ARDC complaints which now are butressed by the Seventh Circuit Opinion.
