Steps

HOW TO FILE AN ATTORNEY DISCIPLINARY COMPLAINT AGAINST AN ATTORNEY

Step One

Determine the kind of  misconduct claim(s) you are making against the Attorney. For example, making misstatement of material facts to a judge, conflict of interest, converting third party funds to pay attorney fees etc. Acquire the Attorney rules of Professional conduct for your state. Click here. http://www.abanet.org/cpr/regulation/scpd/disciplinary.html  Read those rules and make a complaint against the attorney based upon those rules. Include all your evidence in the complaint. Contact your state disciplinary commission which is listed in the above hot link. Request a complaint information and form. 

Step Two

Locate an attorney disciplinary rights advocacy group like the Americans for the Enforcement of Attorney Ethics (AEAE) ldms4@hotmail.com   since 1974, that offers support and resources for attorney  and judicial disciplinary cases. Such a group should have administration expertise to expedite the complaint.

Step Three

Make sure when you file your complaint that it will be held in firm confidence.

Step Four

Support your complaint against the attorney or judge by collecting documentation. Collect only evidence that is legally allowed. The advocacy group can help you with this matter.

Step Five

Stay in contact with the advocacy group after you file your complaint. There may be further recourse and assistance.

Step Six


Most important Remain determined regardless of how long your complaint takes in being resolved. It is quite a feat to file a complaint against a lawyer or judge, but you can consider that you have done a great public service for reporting it as your actions will help protect other people from becoming victims of the same lawyer or judge. Remember we get the legal system we deserve. We all must work together to keep the system honest!

 Step Seven

If the your state attorney disciplinary commission fails to "charge" the attorney complainted of, then you file a Petition for Writ of Mandamus with you State Supreme Court requesting that the Supreme court "order" the State Disciplinary Commission to "charge" the attorney. If the State Supreme Court denies your request then "file" a Petition for Writ with the U.S. Supreme Court and/or a Petition for Writ of Mandamus under U.S. Supreme Court Rule 20  3a and request that the U.S. Supreme Court "order" your state Supreme Court to order your state attorney disciplinary commission to "charge" the offending attorney. The point is you don't stop until the "bad" attorneys are "evicted" from the practice of law! That includes attorneys who are members of disciplinary commissions that "fail" and/or "refuse" to charge corrupt attorneys with mis conduct. When those attorneys in charge of "charging" corrupt attorneys "fail" to do so, these so called administrators of attorney ethics attorneys are the "worst" offenders and "they" must "go"  too!
In the first century the Roman poet Juvenal asked "quis custodiet ipsos custodes" "who guards the guards?" When the "guards" are corrupt they must be eliminated from the practice of law as well!
